Refund of contributions upon relocating abroad
A refund of contributions, as a rule, cannot be made in favour of Germans, because even when resident abroad they are entitled to arrange voluntary insurance provisions.
The implications for EU, EEA, Swiss nationals and nationals from Contracting States are regulated by the provisions of Community law or the regulations of the particular Agreement.
It is not possible to make refunds to nationals of other States (non-Agreement States) who are domiciled in a EU Member State, because by residing in the particular EU Member State, they are entitled to make voluntary contributions to social insurance in Germany. Where these insured persons relocate their place of residence to a non-Agreement State overseas, they are entitled to receive a refund of their contributions after the completion of a waiting period of 24 months following their departure from Germany.
Submitting an application
If you wish to receive benefits from the statutory pension insurance agency such as a pension, rehabilitation benefits or a refund of contributions, you must submit an appropriate application. Benefits of this kind are not simply “officially” approved. The fulfilment of the benefit conditions alone does not guarantee that the particular benefit will be paid out.
No particular form of benefit application is prescribed for statutory pension entitlements, so you may apply orally or by email. Despite this, you will be required to complete and sign the requisite application forms to ensure that your application is properly processed.
Any insured person, or any beneficiary over 15 years old, may submit an application. A legal representative or authorised person may also submit the application. An application in respect of pension benefits can be submitted to any agency office which pays out social benefits, irrespective of the precise area for which the particular office is competent. Pension applications will also be accepted by the local and municipal government administration offices, German governmental offices abroad (embassies and consulates) and officials working on behalf of the governmental insurance agencies.
To keep the processing time to a minimum, it makes sense, for example, to submit pension applications directly to the competent pension insurance agency, regional information and advice centre near to where you live or to a voluntary insurance advisor. The application should include all necessary original documentation such as personal ID card, birth certificate, death certificate, insurance and education certificates etc. Please note: a delay in submitting your application may lead to the delayed start of your pension payments.
